Loyalty Program Terms
PLEASE READ THESE LOYALTY PROGRAM TERMS (THE “LOYALTY TERMS”) CAREFULLY. BY APPLYING FOR, ACCESSING OR OTHERWISE PARTICIPATING IN THE SPORTS RESEARCH® LOYALTY PROGRAM (THE “PROGRAM”), YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS THAT FOLLOW. IF YOU DO NOT AGREE TO THESE LOYALTY TERMS, YOU MUST STOP AND YOU MAY NOT PARTICIPATE IN THE PROGRAM.
Program Eligibility. The Program is a free rewards program offered by Sports Research Corporation ("SR", “we”, “us” or “our”) to its customers located in the U.S. Participation in the Program is limited to individuals only and is limited to one account per individual. You must be age 18 years or older and a legal resident of the United States to be eligible to participate in the Program. No purchase is necessary to participate in the Program. If you have a shipping address outside of the U.S., but are a U.S. resident, please contact us at support@sportsresearch.com to determine eligibility.
Privacy Policy and Other Terms and Conditions. BY APPLYING FOR, ACCESSING OR OTHERWISE PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY SR'S PRIVACY POLICY AND THE TERMS & CONDITIONS APPLICABLE TO THE USE OF OUR WEBSITES SPORTSRESEARCH.COM AND/ OR SWEETSWEAT.COM (THE “SITES”). As explained in our Privacy Policy, we use, and retain the information we collect to, among other things, administer and maintain the Program, detect security incidents, and protect against malicious, deceptive, fraudulent, or illegal activity, including attempts to manipulate accumulated Points (as defined below) or to share Benefits (as defined below) or to violate these Loyalty Terms.
Changes to the Program. SR may, at any time in its sole discretion, alter, limit, or modify these Loyalty Terms, as well as the Program rules, regulations, Benefits, Points, eligibility requirements and/or any feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse), and/or terminate the Program in whole or in part, even though such changes may affect the value of accumulated Points or the ability to obtain certain Benefits. Any changes or modifications will be effective upon posting to our Sites. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.
Joining the Program. To enroll in the Program and start earning loyalty points (each, a “Point”), you will need to have an account on one of our sites (each, an “SR Account”). For existing accountholders, sign in to your SR Account and, upon seeing the pop-up message inviting you to Unlock VIP Status, review the Loyalty Program Terms and then click “Accept Loyalty Terms & Sign In”. If you do not have an SR Account today, navigate to the My Account page, click “Create Account”, and, upon seeing the pop-up message inviting you to Unlock VIP Status, review the Loyalty Program Terms and then click “Accept Loyalty Terms & Create Account”. If you opt out of the Program and decide to join later, you can do so at any time by visiting <LOYALTY> [TR2] and clicking “Join Now”.
How to Earn Points. A Program participant (each, a “Member”) can start earning Points immediately by making purchases of qualifying merchandise on the Site(s) (“Qualified Purchase(s)”) and by taking certain actions (for example, posting a product review, following SR on Instagram, etc., subject to change). The initial conversion rate will be 1 Point per $1 spent but total Points earned will vary based on promotions, products and/ or membership tier, as described and posted on <LOYALTY> from time to time. A Qualified Purchase includes regular and sale priced merchandise and excludes gift cards, sales tax, state fees, discounts, shipping and delivery charges and/or other charges specified by us from time-to-time. Points are only awarded based on full dollars spent; purchase prices will be rounded down to the nearest full dollar amount to calculate Points. If not redeemed within a 12-month period, Points will automatically expire without notice. Points earned through the Program have no monetary value and are not redeemable for cash, and cannot be altered, sold, bartered or transferred.
How to Make a Qualified Purchase. To make a Qualified Purchase through the Sites, you must be signed in to your SR Account when placing the order and keep at least one qualifying item from the order. If you make a Qualified Purchase and later return all the items in the order, that order is no longer a Qualified Purchase and any Points earned will be removed from your total accumulated Points.
Points Accrual. Points based on Qualified Purchases will appear in your SR Account thirty (30) days after the date that the first item in your Qualified Purchase ships. The Points balance will be shown as “pending” until the last item in the Qualified Purchase ships, at which time the Points for the entire order will be awarded. This timing will apply also to split orders resulting from backordered items, presale items, or any other reason. If any part of a Qualified Purchase is cancelled after all other items have shipped, any Points attributable to that Qualified Purchase will be granted at the time of cancellation of the last remaining item.
You can also earn Points by taking certain “earn actions” such as signing up for promotional emails or electing to “follow” SR on social media through the link provided on the Sites. (All actions taken by you on third-party social media websites or apps must comply with the applicable terms of service for that website or app.) Please note that SR is not responsible for the content or the information practices of such social media sites. In the case of “earn actions,” Points will be allocated to your SR Account as soon as practicable. Point values and methods for accumulation are changed frequently without notice and SR is not obligated to maintain any Points offer available to any particular Member for any specific duration. Please check <LOYALTY> frequently for updates.
Program Benefits. Members may receive personalized offers, coupons, discounts, promotional items and gifts depending upon their membership status (“Benefits”). Benefits may be customized based on purchase behaviors and preferences. Benefits such as coupons may have certain restrictions including, without limitation, that Points cannot be combined with other discounts or offers; and expiration dates, and short, time-limited redemption periods may apply. Read each Benefit offer carefully for specific details. Points must be redeemed at time of purchase and may not be applied retroactively. Only the SR Account holder may earn and use the Points and Benefits tied to that account.
Using Points. Points can be redeemed to purchase merchandise or promotional items (e.g., cups, shirts, gym bags); or be converted to coupons, usable on specified merchandise purchases.
Membership Tiers: Currently, there are three tiers of membership in the Program: Bronze, Silver and Gold. Achieving Silver or Gold status requires a minimum spend per year, as explained below. From time to time, SR may make certain Benefits available to each membership tier, certain tiers or none of the tiers, in its sole discretion, including additional methods or expedited timeframes for accumulating Points. Benefits may vary by tier and some tiers may have more Benefits than others. The type, timing and availability of any Benefits will be determined by SR in its sole discretion. SR may, in its sole discretion, alter, limit, or modify the tier rules, regulations, Benefits, eligibility for membership, or any other feature of a particular tier or may terminate a particular tier at any time in its sole discretion, without prior notice except as expressly set out in these Loyalty Terms or required by applicable law.
Bronze
All Members are automatically in the Bronze tier upon enrollment in the Program. Subject to termination or removal from the Program (as explained in Section 11 below), a Member will remain at Bronze indefinitely unless the minimum annual spend required to achieve Gold or Silver status is met.
Silver
Silver status is conferred on those registered Members who spend a minimum of $230 (subject to change) on Qualified Purchases during a one-year period. Points expire upon one calendar year from the date the Qualified Purchase is made. Silver status is good for the one-year period in which the Member qualifies. After that, requalification is required on an annual basis.
Gold
Gold status is conferred on those registered Members who spend a minimum of $355 (subject to change) on Qualified Purchases during a one-year period. Points expire one calendar year from the date the Qualified Purchase is made. Gold status is good for the one-year period in which the Member qualifies. After that, requalification is required on a yearly basis.
If a Member does not requalify for Silver status and/or does not requalify for Gold status, the Member’s status will revert to the tier corresponding to the appropriate minimum spend on Qualified Purchases during the preceding year. If the Points attributable to any returned items are responsible for an increase in your tier status, SR reserves the right to reduce your tier status accordingly.
Termination or Removal from Program. SR reserves the right to exclude individuals from the Program, remove Points and/or cancel orders otherwise constituting Qualified Purchases that are not consistent with SR’s policies and/or procedures in its sole but reasonable discretion. In particular, any abuse, manipulation or "gaming" of the Program or its rules (as determined by SR) including multiple redemptions by the same individual via different accounts, failure to follow the Loyalty Terms, Program inactivity for more than 12 months, reselling Points or merchandise, any misrepresentation or any conduct detrimental to the interests of SR not otherwise protected by law may subject Members to expulsion from the Program or deduction of Points obtained through these abusive or manipulative activities, and will affect eligibility to resume participation in the Program at a later date. SR uses a third-party provider to monitor purchases and identify activities that violate these Loyalty Terms or any other SR policy or procedure. SR uses this data to help it make decisions regarding participation in the Program, awarding Points and fulfillment of Qualified Purchases. Membership is non-transferable and Qualified Purchases must be made by the Member. If your membership is revoked or otherwise cancelled, any Points in your account will automatically expire. SR reserves the right to make changes to its Sites, Loyalty Terms and the Program rewards at any time. It is your responsibility to check back frequently from time to time to keep informed of any changes.
Unenrollment; Opt-Out. If you choose to unenroll (i.e. opt-out) from the Program, you can do so by signing in to your SR Account and, upon viewing the landing page, selecting “Click here to opt-out of the Sports Research® Rewards Program”. You may also opt-out by contacting SR at support@sportsresearch.com or [SR PHONE NUMBER]. If you elect to rejoin the Program later, you can do so at any time by navigating to the Program landing page and clicking “Join Now,” or by contacting SR at the same email or phone number provided above. If you unenroll at any time, you agree to the following:
You will forfeit all of your existing Points, tier status, and tier Benefits and not be able to redeem any Points or Benefits.
You will no longer accrue Points on Qualified Purchases.
You will be opted out of all communications related to the Program.
You will still receive open orders and/or returns.
Returns and Exchanges. Any product you receive through redeeming Points cannot be exchanged or returned for another product or a monetary refund. Returns of merchandise purchased with Points or using other Benefits will be the price actually paid after using Points or other Benefits. Neither the Points nor any Benefit value will be refunded. Exchanges will be credited for the full transaction value after discounts.
Notice of Financial Incentive. Under certain state privacy laws, this Program may be considered a “financial incentive” or a “bona fide loyalty program.” To view our notice of financial incentive, please visit: Notice of Financial Incentive
Optional Participation. Participation in the Program is always optional and not a condition of purchase. By applying for the Program, you are required to opt-in to receive advertising, marketing materials and other communications from SR relating to the Program. If you object to any of these Loyalty Terms or any changes to the Loyalty Terms or the Program, or at any time become dissatisfied with the Program, your sole recourse is to opt-out of the Program, as described in Section 12. If you opt-out you agree to be subject to the terms and conditions of Section 12.
Your Membership Is Personal. Each SR Account and the Program membership that corresponds to an SR Account is personal and may not be assigned, transferred, or shared with family or friends, or assigned, transferred, shared or used for commercial purposes. You are the sole authorized user of any SR Account you create and are solely and fully responsible for all activities that occur under your SR Account. It is your responsibility to protect the integrity of your SR Account and password. You agree that the information you provide to us during the registration process and at all other times when enrolled in the Program is accurate, current, and complete, and that you will keep it up-to-date at all times. If you provide any information that is, or that SR has reasonable grounds to suspect is, untrue, inaccurate, not current, or incomplete, SR has the right to suspend or terminate your SR Account and refuse any and all current or future participation in the Program.
Governing Law. Unless otherwise expressly stated herein, the laws of the United States of America and the laws of the State of California, without regard to the principles of conflicts of laws, will govern these Loyalty Terms, your participation in the Program, and all matters relating to your access to, and/or use of, the Program.
Disputes. As provided in the Terms & Conditions, you and SR agree, with limited exceptions, to resolve all disputes between you and SR through BINDING ARBITRATION. ARBITRATION MEANS THAT YOU AND SR ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
